Safeguarding Adults - A Consultation on the Review of the ‘No Secrets’ Guidance

The Department of Health, the Home Office and the Ministry of Justice launched a national consultation on the review of the No Secrets guidance.

The consultation paper was about how we identify and manage risk, particularly as we move towards increasing choice and control for people with learning disabilities. The DSA has responded to the consultation with our view of the need for better safeguarding, to include issues around prevention, managing risk and choice, training, guidance and legislation. Specifically, we have asked that:

  • responsibility is placed on agencies to identify (as well as respond to) risks to an individual's independence, their safety and well-being at the assessment and care planning stages;
  • this personalised approach must be developed in relation to managing risk and independence as opposed to simply avoiding harm;
  • there should be a duty on professionals to react to concerns from others, whether or not they believe there is a risk themselves.
